KCC assesses $62,750 in fines against 48 motor carriers
The Kansas Corporation Commission (KCC) assessed $62,750 in fines and penalties against 48 motor carriers for violations of Commission rules and regulations during the first-quarter of the state's fiscal year 2007 (July 1, 2006 to September 30, 2006). The violations were discovered during Safety Compliance Audits of 165 motor carriers performed by the Commission's Transportation Division.
The Commission has fined the following motor carriers:
- Andale Ready Mix Inc., Andale, Kans. $1,250 for three safety violations. The violations include failure to maintain a current motor vehicle record for each driver employed, and allowing or requiring a driver to operate a commercial motor vehicle without a valid medical examiners certificate and without completing a driver vehicle inspection report.
- Big Sugar Lumber and Home Center Inc., Fort Scott, Kans. $1,000 for two safety violations. The violations include failure to maintain a current motor vehicle record for each driver employed and allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
- Borton L.C., Hutchinson, Kans. $2,500 for three safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program for drivers, failure to maintain driver qualification files, and allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
- Colby Implement L.L.C., Colby, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a valid medical examiners certificate.
- Clay R. Cole d.b.a. C. R. Wrecker Service and Trucking, Baxter Springs, Kans. $3,500 for five safety violations. The violations include failure to require record of duty status reports, failure to maintain a current motor vehicle record for each driver, for allowing or requiring a driver to complete a trip without completing a driver vehicle inspection report, to operate a commercial motor vehicle without a periodic inspection, and without proper operating authority.
- C and R Ice LLC, Lebo, Kans. $2,000 for allowing or requiring a driver to operate a commercial motor vehicle without first receiving a negative pre-employment controlled substance test report.
- Brandon Conkle d.b.a. Conkle Trucking, Burlington, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle in intrastate commerce without first obtaining for-hire operating authority.
- C & R Farms Inc. d.b.a. Roger Cooley Trucking Inc., Scott City, Kans. $3,500 for five safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program, failure to maintain driver qualification files for each driver, allowing or requiring a driver to complete a trip without completing a driver vehicle inspection report, to operate a commercial motor vehicle without a periodic inspection and for improperly using a farm registered vehicle.
- Dreiling Construction LLC, Garden City, Kans. $1,500 for two safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program and for allowing or requiring a driver to complete a trip without completing a driver vehicle inspection report.
- Feist Furniture and Design Center LLC, Lenexa, Kans. $1,000 for two safety violations. The violations include failure to maintain a current motor vehicle record for each driver and for allowing or requiring a driver to operate a commercial motor vehicle without first having a valid medical examiners certificate.
- Fleet Transportation Specialists LLC, Overland Park, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle in intrastate commerce without operating authority.
- DC & B Supply Inc., Pratt, Kans. $1,000 for two safety violations. The violations include failure to maintain driver qualification files for each driver and for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
- F & H Insulation Inc., Wichita, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
- Genesis Well Service Inc., Pratt, Kans. $2,000 for two safety violations. The violations include failure to maintain driver qualification files for each driver and failure to implement an alcohol and/or controlled substance testing program.
- Roderick Ian Granish d.b.a. AM-PM Services, Kansas City, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
- Holland Paving Inc., Wichita, Kans. $4,000 for five safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program, failure to require a driver to prepare duty status reports, allowing or requiring a driver to operate a commercial motor vehicle without a valid medical examiners certificate, make false entries on record of duty status reports, and complete a trip without completing a driver vehicle inspection report.
- Ronald Holle, Bremen, Kans. $500 for allowing or requiring a driver to complete a trip without completing a driver vehicle inspection report.
- Homeland Ready-Mix Inc., Parsons, Kans. $3,500 for five safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program, allowing or requiring a driver to operate a commercial motor vehicle without a valid medical examiners certificate, failure to maintain a current motor vehicle record for each driver, allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection, and complete a trip without completing a driver vehicle inspection report.
- Homestead Rental Inc. d.b.a. Furniture Warehouse, Manhattan, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
- Industrial Pallet and Lumber Reclamation Inc., Wichita, Kans. $2,000 for three safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program, failure to maintain driver qualification files for each driver, and for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
- Gary Jensen d.b.a. Jensen Excavation, Belleville, Kans. $1,500 for three safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program, failure to maintain driver qualification files for each driver, and failure to require driver record of duty status reports.
- Joy Distribution Inc., Wichita, Kans. $2,000 for two safety violations. The violations include failure to maintain driver qualification files for each driver and failure to implement an alcohol and/or controlled substance testing program.
- JMB Homestores LLC d.b.a. Bassett Furniture Direct, Lenexa, Kans. $500 for allowing or requiring a driver to complete a trip without completing a driver vehicle inspection report.
- Michael Josserand and Patrick Josserand d.b.a. P&M Farms, Johnson, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a valid medical examiners certificate.
- Kanza Cooperative Association, Iuka, Kans. $3,000 for three safety violations. The violations include three events of intentionally hiring farm registered vehicles to move stock pile grain to an elevator.
- Adalberto Martinez Jr. d.b.a. Martinez Cattle Transportation, Garden City, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle in excess of the allowed 60 hours in 7 consecutive days.
- McAlister Oil LLC, Wellington, Kans. $2,500 for three safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program, allowing or requiring a driver to complete a trip without completing a driver vehicle inspection report, and failure to require record of duty status reports.
- Midwest Mixer Service LLC, Scott City, Kans. $2,500 for three safety violations. The violations include allowing or requiring a driver to operate a commercial motor vehicle in excess of 14 hours without 10 hours off-duty, failure to require record of duty status reports, and allowing or requiring a driver to make false entries in a record of duty status report.
- Timothy Nightingale d.b.a. Hi-Plains Transport, Ulysses, Kans. $1,000 for allowing or requiring a driver to operate a commercial motor vehicle without a negative pre-employment controlled substance test report.
- Nima's Inc., Kansas City, Kans. $500 for failure to maintain driver qualification files for each driver employed.
- O'Brien Rock Company Inc., Saint Paul, Kans. $1,500 for two safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program and for allowing or requiring a driver to operate a commercial motor vehicle without a valid medical examiners certificate.
- Pals Glass Service Inc., Wichita, Kans. $1,000 for two safety violations. The violations include allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection and without completing a driver vehicle inspection report.
- Pitt Plastics Inc., Pittsburg, Kans. $500 for failure to maintain a current motor vehicle record for each driver employed.
- Rhoads Construction Company Inc., Goodland, Kans. $1,500 for two safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program and for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
- R & M Trailer Service Inc., Kansas City, Kans. $1,000 for failure to implement an alcohol and/or controlled substance testing program for each driver employed.
- Frank Rock, Shawnee, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
- Tim Sicka d.b.a. Recycling Connection, Piqua, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
- Skyland Grain LLC, Johnson, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a valid medical examiners certificate.
- Donna J. Murray d.b.a. Southeast Kansas Vending, Girard, Kans. $500 for failure to maintain driver qualification files for each driver employed.
- Pro Fencing LLC, Newton, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
- S & S LLC d.b.a. K & K Oil Company, Liberal, Kans. $1,000 for failure to implement an alcohol and/or controlled substance testing program.
- Richard Strong d.b.a. Ball Xpress, Eudora, Kans. $1,500 for two safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program and for failure to maintain a current motor vehicle record for each driver employed.
- Danny Joe Thomas d.b.a. Danny's Wrecker Service, Columbus, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a valid medical examiners certificate.
- Traffic Control Services Inc., Wichita, Kans. $1,000 for two safety violations. The violations include allowing or requiring a driver to operate a commercial motor vehicle without a valid medical examiners certificate and without a periodic inspection.
- Washington Electronics Inc., Pittsburg, Kans. $1,000 for allowing or requiring a driver to operate a commercial motor vehicle without operating authority.
- Reed Dillon & Associates Inc., Lawrence, Kans. $1,500 for two safety violations. The violations include allowing or requiring a driver to operate a commercial motor vehicle without operating authority and without a periodic inspection.
- Danny Weippert d.b.a. D & D Trucking, Garden City, Kans. $1,000 for failure to implement an alcohol and/or controlled substance testing program.
- Jake Wiebe d.b.a. Jake's Trucking, Copeland, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a valid medical examiners certificate.
The Transportation Division offers free compliance seminars. The seminars are held weekly on a rotating basis in Topeka, Hutchinson, Hays, and Garden City. The seminars, beginning at 9:00 a.m. and lasting approximately two hours, are presented by the Commission's Transportation Division staff and are designed to help Motor Carriers comply with Safety and Economic Regulations. The KCC Transportation Division is responsible for regulating public and private motor carriers in Kansas. The Commission's goal is to ensure appropriate and effective regulation and oversight of motor carriers and protect the public interest and safety.
