Underground Natural Gas Storage
The State of Kansas has authorized the Commission to assume jurisdiction over intrastate natural gas pipeline safety and adopt regulations as may be necessary to ensure conformance with the Natural Gas Pipeline Safety Act (“Pipeline Safety Act”) of 1968, 49 U.S.C. § 60101 et seq., as amended. The Commission has adopted necessary regulations under the Kansas Natural Gas Pipeline Safety Act (“Kansas Pipeline Safety Act”). Furthermore, the Commission has established a pipeline safety program pursuant to K.S.A. 66-1,150. The Commission voluntarily submits a Certification pursuant to 49 U.S.C. 60105 (“60105 Certification”) annually to participate in the federal pipeline safety program including an Underground Natural Gas Storage (UNGS) program. By submitting the certification, the Commission assumes inspection and enforcement responsibility with respect to jurisdictional intrastate UNGS facilities. In doing so, the Commission must adhere to the federal pipeline safety program requirements associated with the 60105 Certification as defined under 49 U.S.C. § 60105.
